Terms of Service

These terms govern your use of the SidePulse website at sidepulse.io (the "Site"), the SidePulse iOS app (the "App"), and purchases of SidePulse products from us. SidePulse is made by InteliWEAR LLC ("we", "us"). By using the Site or the App, or buying a product, you agree to these terms. If you don't agree, please don't use them.

Using the Site and the App

You may use the Site and the App for your personal or internal business purposes, in line with these terms and applicable law. You agree not to:

misuse our services, including the push relay, by sending spam, overloading or probing them, or trying to access them in unauthorized ways;
use them to harm others or to break the law;
interfere with other users' devices or pairings.

We may suspend access to a service, such as the push relay, if it is being misused.

The iOS App

The App is licensed, not sold, to you. Apple's Licensed Application End User License Agreement applies to your use of the App, together with these terms. Apple is not responsible for the App or its support, and has no obligation to provide maintenance or support for it.

Beta versions distributed through TestFlight are pre-release software. They may contain bugs, change, or stop working at any time.

Open source

The SidePulse command-line tools and iOS app source code are published on GitHub under open-source licenses. Your use of that source code is governed by the license in each repository, not by these terms. The SidePulse name and logos are trademarks of InteliWEAR LLC and are not licensed by those open-source licenses.

Orders and payment

Prices are shown on the Site and may change at any time before you order. Taxes and shipping are shown at checkout.
Payment is processed by Stripe. By placing an order you confirm that you are authorized to use the payment method.
We may refuse or cancel an order before it ships, for example if a product is unavailable or a price was listed in error. If we cancel, we will refund any amount charged.
Shipping times on the Site are estimates. Title and risk of loss pass to you when the product is handed to the carrier.

No returns; 3-month warranty

All sales are final. We don't accept returns or exchanges for change of mind.

We warrant that SidePulse hardware will be free from defects in materials and workmanship for 3 months from delivery. If a product fails under normal use during that period, contact us and we'll repair or replace it, at our option. This warranty doesn't cover damage from misuse, accidents, modification, or normal wear. Repair or replacement is your only remedy under this warranty. Some jurisdictions give you rights that can't be waived, and nothing in these terms limits those rights.

Using the hardware safely

SidePulse devices are small accessories that plug into your computer or phone. Insert and remove them as described in the setup guide. Keep them away from small children, since they are small parts and may be a choking hazard. Don't use a damaged device. We are not responsible for damage caused by misuse, modification, or use contrary to the setup guide.

SidePulse is a status indicator, not a safety or alerting system. Don't rely on it where a missed or delayed notification could cause harm, injury, or loss.

Content and intellectual property

The Site, the App, and their content, design, and branding are owned by InteliWEAR LLC or its licensors, except where an open-source license says otherwise. LED patterns you create are yours. By sharing a pattern publicly (for example, with a pattern link), you let others view and use it.

Third-party services

The Site and the App rely on third-party services such as Apple push notifications, Stripe, Google, and GitHub. We aren't responsible for those services, and their own terms apply to your use of them.

Disclaimers

Except for the hardware warranty above, the Site, the App, and the push relay are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that they will be uninterrupted, error-free, or that every message will be delivered.

No liability

To the fullest extent permitted by law, InteliWEAR LLC and its owners, employees, and suppliers are not liable for any damages of any kind, whether direct, indirect, incidental, special, consequential, or punitive, including loss of data, profits, or revenue, or damage to your devices, arising from your use of the Site, the App, the push relay, or our products, even if we were told such damages were possible. Your only remedy for a defective product is the warranty above. Some jurisdictions don't allow these exclusions, so they may not fully apply to you; where that's the case, our liability is limited to the smallest amount the law allows.

Indemnity

You agree to indemnify InteliWEAR LLC against claims arising from your misuse of the Site, the App, or our products, or your violation of these terms.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Santa Clara County, California, unless the law where you live gives you the right to bring a claim in your local courts.

Changes

We may update these terms from time to time. When we do, we'll change the "Last updated" date above. Continuing to use the Site or the App after a change means you accept the updated terms.
